I've read the posts about Lintot Square development and would like to raise a query that members may, or may not be able to help with.
Yes, the flats are expensive but I'm hoping to buy one; they're a good size and it appears a nice area with lots of facilities. However, there's a problem on the legal front with Horsham DC.
The Village centre is essentially a large private estate (owned by Horsham DC) with the only adopted road being the main one in from Worthing Road. It ceases being adopted at the entrance to the car park. All areas beyond the adopted road are part of the private estate but are fully accessible to and have facilities for the public at large. However, financial responsibility for the maintenance of those areas lies with the surrounding leaseholders (flats, shops, offices etc) and not with the council. So.....leaseholders are responsible for the car park, pavements, lights, bollards etc, beyond the curtilage of their own block.
This arrangement is, as far as my solicitors are concerned totally new and other people I have spoken to have not come across it either. Horsham seem unwilling to discuss it. It is therefore proving a deterrent to buying the property.
If anyone has any views or if anyone from the council or the local community can confirm or contradict this understanding, it would be appreciated!
